These Terms and Conditions (“Terms”) govern your use of the My Family Album mobile application and related services (collectively, the “Services”), developed by Kidslox.
By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
1. Eligibility
The Services are intended for use by adults, parents, and legal guardians.
By using the Services, you represent that:
- You are at least 18 years old, and
- You are the parent or legal guardian of any child whose photos, videos, or profile information you add to the app.
The app is used by parents to preserve their own children’s memories; children may not create accounts independently.
2. Account Registration
You need to create an account to use the Services. Authentication is provided through Firebase.
You agree to:
- Provide accurate information
- Keep your login credentials secure
- Accept responsibility for activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Your Content
My Family Album lets you upload photos and videos and organise them into private stories and timelines across one or more child profiles.
- You retain full ownership of all photos, videos, and other content you add.
- Because your media is encrypted on your device before upload, you grant us only the limited rights necessary to store, sync, and deliver your encrypted content to the family members you invite.
- You confirm that you have the right to upload the content and to include any people who appear in it, and that you have the authority to do so on behalf of your children.
- You are responsible for maintaining access to your account and encryption keys; if these are lost, encrypted content may become unrecoverable.
4. Acceptable Use
You agree to use the Services only for lawful, personal, and non-commercial purposes.
You must not:
- Violate applicable laws
- Upload harmful, unlawful, or infringing content
- Upload content of children for whom you are not the parent or legal guardian
- Attempt to interfere with app security or functionality
- Reverse engineer or copy the Services
- Use the Services to exploit or harm children
5. Private Family Sharing
Content is shared only with family members you explicitly invite and is never posted publicly by us. You are responsible for choosing who you invite. Invited members may be able to view and save the content you share with them; please only invite people you trust.
6. Subscriptions and Payments
Some features may require a paid subscription or in-app purchase.
Purchases and subscriptions are processed through your Apple App Store account. Subscriptions may automatically renew unless cancelled before the renewal date through your App Store account settings.
All billing and payment processing is handled by the App Store. Except where required by law, fees are non-refundable.
7. Intellectual Property
All content, trademarks, branding, software, graphics, and materials associated with the Services (excluding your own uploaded content) are owned by or licensed to Kidslox.
You may not copy, distribute, modify, or exploit any part of the Services without written permission.
8. Privacy
Your use of the Services is also governed by our Privacy Policy.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the maximum extent permitted by law, we disclaim all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Availability or error-free operation
While we use strong encryption and reasonable safeguards, we do not warrant that the Services will be uninterrupted or that data will never be lost.
10. Limitation of Liability
To the fullest extent permitted by law, Kidslox shall not be liable for:
- Indirect or consequential damages
- Loss of data or content
- Loss of profits
- Issues caused by third-party providers
Our total liability shall not exceed the amount paid by you for the Services in the previous 12 months.
11. Termination
We may suspend or terminate access to the Services at any time if:
- You violate these Terms
- We reasonably believe misuse or abuse has occurred
- Continued operation becomes impractical or unlawful
You may stop using the Services and delete your account at any time.
12. Changes to the Services or Terms
We may modify the Services or these Terms at any time.
Continued use after changes become effective constitutes acceptance of the updated Terms.
13. Governing Law
Except for disputes that can be brought in small claims court, all disputes between you and us, including any dispute regarding this Agreement, shall be exclusively settled through binding arbitration through the American Arbitration Association (“AAA”) pursuant to the AAA’s then-current rules for commercial arbitration. Any such arbitration proceeding will be conducted solely in English.
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. If the arbitration in this section provision is found unenforceable or not to apply for a given dispute, then the proceeding must be brought exclusively in a court of Delaware jurisdiction.
